Please read these terms carefully before using our customs brokerage services.

Section 1

Agreement to Terms

By accessing or using the services of Corleen Customs Brokerage ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Section 2

Services Description

Corleen Customs Brokerage provides:

  • Customs brokerage services for imports and exports
  • Trade compliance consulting
  • Freight forwarding and logistics coordination
  • Tariff classification assistance
  • Duty recovery and drawback services
  • Documentation preparation and processing
Section 3

Client Responsibilities

As a client, you agree to:

  • Provide accurate, complete, and timely information for all shipments
  • Ensure all documentation is truthful and compliant with applicable laws
  • Maintain proper records as required by CBSA regulations
  • Promptly respond to requests for additional information
  • Pay all fees, duties, taxes, and charges in a timely manner
  • Comply with all applicable import/export laws and regulations
Section 4

Authorization

By engaging our services, you authorize Corleen Customs Brokerage to act as your agent for customs clearance purposes, including but not limited to:

  • Filing customs declarations with CBSA on your behalf
  • Paying duties and taxes on your behalf (for reimbursement)
  • Communicating with government agencies regarding your shipments
  • Signing documents as your authorized representative
Section 5

Fees and Payment

  • Fees for our services will be provided in a quote prior to service commencement
  • All duties, taxes, and government fees are the responsibility of the client
  • Payment terms are net 30 days unless otherwise agreed in writing
  • Late payments may be subject to interest charges
  • We reserve the right to hold shipments until outstanding balances are paid
Section 6

Limitation of Liability

To the maximum extent permitted by law, Corleen Customs Brokerage shall not be liable for:

  • Delays caused by government agencies, carriers, or other third parties
  • Errors resulting from inaccurate or incomplete information provided by client
  • Penalties or fines resulting from client's non-compliance
  • Loss of business, profits, or consequential damages
  • Acts of God, war, terrorism, or other events beyond our control

Our total liability shall not exceed the fees paid for the specific service in question.

Section 7

Indemnification

You agree to indemnify and hold harmless Corleen Customs Brokerage, its officers, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your breach of these Terms of Service
  • Inaccurate or fraudulent information provided by you
  • Your violation of any applicable laws or regulations
  • Your infringement of any third-party rights
Section 8

Confidentiality

We will maintain the confidentiality of your business information and will not disclose it to third parties except as required to perform our services, comply with legal obligations, or as authorized by you.

Section 9

Compliance with Laws

Both parties agree to comply with all applicable Canadian laws and regulations, including but not limited to the Customs Act, Customs Tariff, and all CBSA regulations and memoranda.

Section 10

Termination

Either party may terminate this agreement with 30 days written notice. We reserve the right to terminate services immediately if you breach these terms or fail to pay outstanding amounts. Termination does not release either party from obligations incurred prior to termination.

Section 11

Dispute Resolution

Any disputes arising from these Terms of Service shall be resolved through negotiation in good faith. If negotiation fails, disputes shall be submitted to binding arbitration in Ontario, Canada, in accordance with the Arbitration Act of Ontario.

Section 12

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Section 13

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective upon posting to our website. Continued use of our services after changes constitutes acceptance of the modified terms.
